The nyan cat is trademarked. The trademark owner has asserted and defended their trademark when people used it for commercial purposes. They also stated that non-commercial use is OK.

Minetest_game is permissively licensed and (apart from the nyan cat) has no -non-commercial- parts.

This nyan cat prevents anyone from doing several things with minetest_game:

- asking people to pay for joining a server
- making a video and putting it on youtube with advertising to make some money for a server
- using minetest_game in a company that offers private tutoring to kids
- using minetest_game in any setting that is not a strict non-for-profit setting, like holding a LAN party in your office

We believe that minetest_game shouldn't restrict any of these uses, hence the removal.

(I won't discuss the details of the removal in this thread. How we remove it and whether we replace it should be a different discusion/thread).

No, you can only file DMCA requests for Copyright Violations, not trademark violations.

EDIT: upon reading your post again I think you may have meant "nyan cat in minetest would be relicensed to CC-BY-NC" which does in deed potentially allow a DMCA request, but without source code we can't prove that they took an older version. Plus the IOS clients are usually only Clients, not Servers, in which case the server artwork is irrelevant.

For anyone interested here is PB&J Pup (redo) which contains the original Nyan Cat alongside the PB&J Pup and has both spawning in world by default... It uses the new 'pbj_pup_generate' setting to turn spawning on/off, has sounds removed (never liked those), candies removed so that rainbows are always in use and textures have been optimized: https://github.com/tenplus1/pbj_pup

I applaud people making alternatives available. Even if I really don't like those alternatives :)

Afaik the Nyan Cat image itself is also protected by copyright. Whether it's enforced or not is a different question. But most artistic works (visual works, literary works, architectural works, musical works, and many others) are automatically protected by copyright in the U.S. for a designated period, depending on when the work was created, regardless of whether the artistic work is actually registered with the Copyright Office. The only exception is if the copyright is specifically waived by the author or licensed otherwise for certain uses.

<edit> just thought, someone could even create a Leprechaun mob which protects them, and you have to fight them to get the pot... and maybe you even win something else special for defeating the Leprechaun as well.

The ideas and possibilities are endless---ish

well actually only Basic Rainbow [rainbow] really does add rainbows and if you are fast enough you may even find a pot of gold. Don't know wether this works underground though

Well, the Nyan cat is just an internet meme. I don't see any reason that a big Company like Coke Cola or Microsoft would like to buy it...
